Terms of Service
1. Acceptance of Terms
By downloading, accessing, or using the App published on Google Play (and any other authorized distribution channel we designate), you agree to these Terms of Service. If you do not agree, do not use the App. We may update these Terms from time to time; continued use after changes become effective constitutes acceptance of the revised Terms. The “Last updated” date at the top shows when these Terms were last revised.
2. Eligibility
You represent that you are legally able to enter into a binding agreement in your place of residence and meet any minimum age required by Google Play and applicable law (often 13+, or older where required). If you use the App on behalf of an organization, you represent that you have authority to bind that organization.
3. License to Use the App
Subject to these Terms and the Google Play Terms of Service where applicable, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App for your own lawful, non-commercial or personal preparation purposes unless otherwise agreed in writing. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or attempt to extract source code from the App except where such restrictions are prohibited by law.
4. Accounts and Security
Certain features may require an account or may sync data through Google Play Services. You are responsible for maintaining the confidentiality of your credentials (including your Google account) and for all activity under your account. Notify us promptly at info@mononymdigitial.com if you believe your account has been compromised.
5. Purchases and Subscriptions
If the App offers in-app purchases or subscriptions (including subscriptions processed through Google Play Billing), pricing, billing, renewal terms, cancellations, refunds, and tax treatment are governed primarily by Google’s policies and applicable law—not solely by these Terms. Please review subscription details shown in Google Play before you purchase. Unused subscription time is not credited except as required by law or Google Play policy.
6. Acceptable Use and User Responsibilities
You agree not to:
- Violate applicable laws, intellectual property rights, or third-party rights.
- Submit unlawful, infringing, deceptive, abusive, harassing, or offensive content through the App or related support channels.
- Interfere with or disrupt the App, servers, networks, or authentication measures—including attempting unauthorized access, automated scraping beyond normal app use, or interfering with others’ use.
- Circumvent payment, entitlement, DRM, licensing, geographic, or parental controls—or use cheats, bots, or modified clients to gain unauthorized advantages unless explicitly permitted by us.
We may investigate suspected misuse and cooperate with vendors and authorities as appropriate.
7. Data Collection and Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the App, you acknowledge that processing may involve service providers such as hosting, analytics, or crash-reporting vendors, as described there.
8. Intellectual Property
The App, including its branding, visuals, puzzles, explanatory text where original to us, software, and documentation, is owned by Mononym Digitial, LLC or our licensors, unless otherwise indicated. Feedback you provide may be used by us without obligation to you unless law requires otherwise.
The Law School Admission Council (LSAC) and LSAT are trademarks of LSAC (or applicable rights holders). LSAC does not sponsor or endorse this App unless explicitly stated. This App is independent study software.
9. Third-Party Services
The App may rely on Google Play Services, Firebase, analytics SDKs, or other third-party APIs. Those services have their own terms and privacy notices. Google’s terms applicable to apps from Google Play may apply alongside these Terms where required.
10. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND WHETHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. STUDY TOOLS MAY CONTAIN EDUCATIONAL CONTENT THAT IS NOT PERSONAL LEGAL ADVICE OR AN OFFICIAL LSAT RESOURCE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Mononym Digitial, LLC, OUR AFFILIATES, DIRECTORS, EMPLOYEES, LICENSORS, OR DISTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR FOR LOSS OF PROFITS, DATA, GOODWILL, BUSINESS, OPPORTUNITY, REPUTATION, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU ACTUALLY PAID TO US FOR THE APP IN THE THREE (3) MONTHS BEFORE THE CLAIM (EXCLUDING FEES PASSED THROUGH TO THIRD PARTIES LIKE GOOGLE) OR (B) FIFTY U.S. DOLLARS (USD $50), UNLESS LAW REQUIRES OTHERWISE.
Some jurisdictions do not allow certain limitations or exclusions as described above; in those jurisdictions, our liability will be limited to the maximum extent permitted.
12. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mononym Digitial, LLC and our affiliates and personnel from and against claims, liabilities, damages, losses, costs, or expenses arising from your use of the App, your violation of these Terms, or violation of applicable law—except where such indemnity is unenforceable.
13. Suspension and Account Termination
We may suspend or terminate access to the App—or delete or disable associated accounts or data—as we reasonably believe necessary for security, fraud prevention, misuse, legal compliance, or protection of users. Upon termination for cause, unpaid subscription periods remain subject to Google Play Billing rules.
You may stop using the App at any time. Uninstall instructions are available via your device and Google Play.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, United States of America, excluding conflicts-of-laws rules requiring application of another jurisdiction’s laws, unless mandatory consumer protections in your residence require otherwise (for example EU/UK consumer protections). Courts in Denver County, Colorado, United States of America shall have jurisdiction for disputes arising from these Terms, unless applicable law dictates a different competent forum—such as mandatory consumer arbitration or small claims options where applicable.
You may contact us first regarding disputes via info@mononymdigitial.com.
15. Export and Sanctions
You may not export, re-export, or transfer the App where prohibited under applicable export controls or sanctions.
16. Changes to These Terms
We may revise these Terms to reflect operational, legal, or policy changes (including addressing new Google Play requirements). For material updates, where required by law or store policy, we will provide notice reasonably in advance—for example via in-app message, updates on our Support page or elsewhere on our website, or Google Play listings. Continuing to use the App after the effective date of changes constitutes acceptance.
17. Miscellaneous
These Terms constitute the entire agreement between you and Mononym Digitial, LLC relating to the App and supersede conflicting prior oral or written agreements on that subject unless we explicitly say otherwise for a separate program. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of substantially all assets.
